Terms of Service

End-User License Agreement (EULA)

This is a contract between ContextForge System ("We", "Us") and You ("User", "Licensee") for the use of Kop Wheel ("Application"). By downloading, installing or accessing the Application from the App Store or Google Play, you expressly agree to these Terms of Service and our Privacy Policy. If you disagree with any provision, do not download, install or use the Application.

1. License Grant

Subject to continued compliance with these Terms, You are granted a non-exclusive, non-transferable, revocable limited license to:

• Install and execute the Application on up to five personal devices that you own or control.
• Use all application features, including spinning wheels, managing lists, adjusting probabilities and exporting results to JSON, TXT, image or CSV formats solely for lawful, personal or classroom purposes.
• Access and store all spin history records locally on your device, subject to your operating system's file retention policies.

2. Pro Subscriptions & Lifetime Purchase

Kop Wheel offers paid entitlement options processed by Apple App Store (pro_monthly, pro_yearly, pro_lifetime) and Google Play Billing (pro_monthly, pro_yearly, pro_lifetime). These purchases are processed on a one-time purchase or auto-renewable subscription basis as detailed at point-of-sale.

• Free Trial: The Premium (pro_yearly) plan provides a 7-day free trial, available only if you have not previously activated it. At the end of the trial, the yearly subscription fee will automatically charge to your Apple ID unless cancelled at least 24 hours before the renewal date.
• Cancellation: Unsubscribe anytime via your Apple ID account settings or Google Play account care. Once cancelled, you retain full Pro features immediately until the end of the current billing period.
• Refunds: All refunds are handled directly through Apple App Store (Apple Refund Policy) and Google Play (Google Play Refund Policy) policies in accordance with your local consumer protection laws.
• Auto-Renewal Price: Monthly plans renew at standard pricing. If you wish nor auto-renew, they will revert to Free tier status after the expiry of the current billing cycle.
• Family Sharing: Purchases made through Apple Family Sharing extend to six family members linked to a single iCloud account. The entitlements belong overdropping family and not connecting separate devices.

3. User Obligations

You agree not to, under any circumstances:

• Create wheel lists that contain illegal, unlawful, discriminatory, harassing, obscene, offensive, hateful, libelous, gambling-oriented material or material that promotes fraud, malware or intellectual infringement infringements.
• Reverse engineer, decompile, disassemble, modify or create derivative works of the Application.
• Use the application to facilitate unlawful or malicious activities or outcomes, including but not limited to unauthorized contests, unregulated lotteries, or gambling simulations for public wagers without valid local gaming licenses.
• Remove, bypass or circumvent any licensing, purchase protection, removable password mechanisms or authentication controls present for legitimate charging mechanisms.

4. Intellectual Property & Spin Results

The Application's source code, logo, visual identity, phonic assets, documentation and compiled binary are the sole property of ContextForge System. The spin history, user configurations, names, photo additions and color themes you create are owned exclusively by you. We make no claim on user-generated data or algorithmic spin seeds generated by your device's random sources.

5. Warranty Disclaimer & Limitation of Liability

The Application is provided "AS IS", without warranty of any kind, express or implied, including but not limited to the warranties of merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the Application will be uninterrupted or error-free.

• Limitation of Liability: To the maximum extent permitted by law, our aggregate liability shall be limited to the price you paid for the Application in the immediate course of action giving rise to the claim.
• Liability Caps: In determining liability, no claim arising out of the valid license, anti-fraud measures or Spin mechanics can be awarded for indirect, incidental, consequential or emotional harm.

6. Privacy Retention & Access Termination

You retain full control over your pumpkin content. Removing the application or clearing application data will locally erase all spin settings and history permanently. We reserve the right to suspend, terminate or disable Pro entitlements if we determine you have used the application in material violation of these Terms, licensing law or local community standards.

7. Governing Law & Dispute Resolution

• Vendor Policies: App Store Purchases are governed by Apple Media Services Terms of Service (available at https://www.apple.com/legal/internet-services/itunes/) and Google Play Payments Terms of Service (available at https://play.google.com/intl/en_us/about/play-terms/).
• Arbitration: Any dispute arising from these Terms shall request binding arbitration in [Your Jurisdiction] unless prohibited by consumer law. You agree to waive jury trial for any claims within the scope of this agreement.
• Class Action Waiver: You agree to bring any claim only as a single, individual action and not as plaintiff or class member in any purported class or representative proceeding.

8. App Store Compliance

These Terms exclusively govern the relationship between you and ContextForge System. Apple and Google have no obligation whatsoever to furnish warranty regarding the Application, provide support, or address claims other than refund management mandated by law.

9. Amendment & Severability

We reserve the right to amend these Terms at any time. Material changes will be published with sufficient notice to allow you to review them before the effective date, which is the date added to this page header. Your continued use of Kop Wheel following the amendment constitutes legal acceptance on the new terms. Certain incompatible provisions may be severed based upon choice of law and jurisdiction requirements.
